USSR Supreme Soviet Resolution on illegal decision by Armenian Supreme Soviet regarding NKAO (Karabakh region of Azerbaijan) (originally published by Adil Baguirov on the Usenet in 1997/10/04) USSR Supreme Soviet Resolution as published in PRAVDA, in Russian, 11 January 1990 Second Edition, p 1 USSR Supreme Soviet Presidium Resolution on the Nonconformity With the USSR Constitution of the Acts on Nagorno-Karabakh Adopted by the Armenian SSR Supreme Soviet 1 December 1989 and 9 January 1990 The USSR Supreme Soviet Presidium notes that the Armenian SSR Supreme Soviet has adopted a number of decisions aimed at blocking the USSR Supreme Soviet resolution of 28 November 1989 "On Measures To Normalize the Situation in Nagorno-Karabakh Autonomous Oblast [NKAO]" which have resulted in the further exacerbation of interethnic relations in and around Nagorno-Karabakh. The Armenian SSR Supreme Soviet's adopted resolutions 1 December 1989 "On the Reunification of the Armenian SSR and Nagorno-Karabakh" and "On the USSR Supreme Soviet Resolution of 28 November 1989 'On Measures to Normalize the Situation in NKAO.'" The proclamation of the reunification of the Armenian SSR and Nagorno-Karabakh without the consent of the Azerbaijan SSR constitutes a direct breach of Article 78 of the USSR Constitution. The Armenian SSR Supreme Soviet's adoption of joint resolutions with an unconstitutional body--the Nagorno-Karabakh National Council-- and the recognition of the Congress of Plenipotentiary Representatives of Nagorno-Karabakh and the National Council formed by it as the sole legitimate authority in the autonomous oblast contravene Articles 2, 78, 86, 87, and 145 of the USSR Constitution. The Armenian SSR Supreme Soviet adopted 9 January 1990 a resolution "On Inclusion in the State Plan for the Economic and Social Development of the Armenian SSR in 1990 of a Plan for the Socioeconomic Development of NKAO in 1990," thus violating the sovereign rights of the Azerbaijan SSR. In connection with the aforementioned, and guided by Articles 73, 76, and 173 of the USSR Constitution, the USSR Supreme Soviet Presidium resolves: 1. To recognize that the Armenian SSR Supreme Soviet resolutions of 1 December 1989 "On the Reunification of the Armenian SSR and Nagorno-Karabakh" and "On the USSR Supreme Soviet Resolution of 28 November 1989 'On Measures to Normalize the Situation in NKAO'" and of 9 January 1990 "On Inclusion in the State Plan for the Economic and Social Development of the Armenian SSR in 1990 of a Plan for the Socioeconomic Development of NKAO in 1990" are not in accordance with the USSR Constitution and, under Article 74 of the USSR Constitution, cannot operate on the republic's territory. 2. To propose the Armenian SSR Supreme Soviet Presidium, on the basis of Point 5 of Article 119 of the USSR Constitution, that it take steps to bring the republic's legislative acts into line with the USSR Constitution.
